Benton County Divorce Records

A divorce action in Benton County is a judicial proceeding that married couples may initiate to legally terminate their union. The documents produced in these cases are called "divorce court records" and are generally accessible through the circuit clerk’s office. The Benton County Circuit Court’s Domestic Relations Division hears all divorce cases.

Benton County divorce records can be requested from the circuit clerk’s office (orally or in writing), in person at the courthouse (where staff can assist with inquiries), or online through the ARCourts case management system. Inspection is generally free, but copies attract a fee assessed by the clerk’s department.

Divorce court records can include petitions, summonses, answers/responses, notices, orders (e.g., support and property division orders), and judgments (the final decrees). While any member of the public can request such records, one should remember that the clerk or the court can release records only if they are not otherwise exempt by law or court order. For instance, Social Security numbers and minors’ identifying information are confidential records.

In 2024, the Benton County Circuit Court recorded a total of 1,879 divorce filings, which consisted of 1,728 standard divorce cases and 151 divorce cases involving support. Of these, the court successfully disposed of 1,832 cases (1,709 standard divorces and 123 divorces with support).
